Finding Cases

The way many people search for cases is arguably inefficient and often yields incomplete results; i.e., they open Westlaw or Lexis, click to search all federal and state cases, type in some search terms and hope their results are good.

The most targeted ways to find cases are (1) annotated statutes, (2) secondary sources, (3) headnotes and key numbers and (4) citators. If you begin your research in statutes or secondary sources, those sources will cite cases if there are any on the topic.  Secondary sources include law review articles, treatises, and other books about legal topics.  Once you have identified one or more good cases on your topic, use the headnotes to search for more cases on that narrow legal issue identified by the topic or key number.  Shepardize or KeyCite your good cases to find more cases, and to find law review articles.
